 I've attached a patch as an RFC... this removes the special 304 path and
 integrates 304 handling in the normal 200 path.

 This is barely tested and may not be the right solution, but if you're in
 a pinch it may help?  If you're interested, test it (thoroughly!) and see
 if it solves your issue?

 I also noticed that this behavior seems unchanged in trunk.
